In view of its significant heritage value and the owner's proposal to carry out demolition works at the site, the Antiquities Authority (Secretary for Development), with the unanimous support of the Antiquities Advisory Board, declared Ho Tung Gardens at 75 Peak Road as a proposed monument under section 2A of the Antiquities and Monuments Ordinance (Cap 53) to provide it with timely protection. The declaration published in the Gazette on Friday, 28 January 2011 and takes immediate effect for a validity period of 12 months. It gives Ho Tung Gardens the statutory protection during the 12-month period and allows the Government more time for further discussion with the owner on preservation options.
